Resolution 2025-07: Environmental Health Plumbing and Medical Gas Regulation for the protection and preservation of public health. WHEREAS, orders and regulations of the Board of Health shall be adopted, recorded, and certified as ordinances of municipal corporations; WHEREAS, pursuant to ORC §731.231 a legislative authority of a municipality may adopt standard ordinances and codes, prepared and promulgated by the state, or any department, board, or other agency thereof or any code prepared and promulgated by a public or private organization which publishes a model or standard code, including but not limited to codes and regulations pertaining to fire, fire hazards, fire prevention, plumbing code, electrical code, building code, refrigeration machinery code, piping code, boiler code, heating code, or air conditioning code, by incorporation by reference; WHEREAS, Ohio Revised Code 3703.01 allows boards of health to regulate plumbing within their health district and “standards and methods prescribed in local plumbing regulations shall not be less than those prescribed in Chapters 3781 and 3791 of the Revised Code and the rules adopted pursuant to those chapters”; WHEREAS, the Delaware County Board of Health finds it necessary to amend the Environmental Health Plumbing and Medical Gas Regulation for the protection and preservation of Public Health or for its own government; and NOW THEREFORE, BE IT RESOLVED BY THE DELAWARE COUNTY BOARD OF HEALTH, BOARD MEMBERS;
  1. That the regulations, attached hereto and incorporated by reference, are intended for the general public and shall be adopted, recorded, certified in the same manner as municipal ordinances. Courts are to give them the same effect as ordinances.
  2. That each regulation shall be read by title only, provided the legislative authority may require any reading to be in full by a majority vote of its members.
  3. That the vote on the passage of each regulation shall be taken by yeas and nays.
  4. That each regulation shall be passed, except as otherwise provided by law, by a vote of at least a majority of all the members of the Board and that all previous versions are rescinded.
  5. That the adopted regulations shall be advertised by publication in a newspaper of general circulation in the district once a week for 2 consecutive weeks and take effect 10 days after first publication … or as provided in Section 7.16 of the Revised Code.
 That the Delaware County Board of Health hereby amends the Environmental Health Plumbing and Medical Gas Regulation. That this resolution shall be in full force and effect on January 1, 2026. Adopted by the Board of Health of the Delaware Public Health District on October 28, 2025.
